Terms of Service

1. Acceptance

By creating an account or using Quizimoto ("the Service"), you agree to these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Service Description

Quizimoto is an embed-first quiz and decision flow platform. The Service includes a web dashboard for building and managing quizzes, embeddable quiz widgets, an API for programmatic access, and webhook delivery for integration with external systems.

3. Accounts

  • You must provide accurate registration information.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately of any unauthorized access to your account.
  • One person or legal entity may maintain multiple workspaces but only one account.

4. Plans and Limits

The Service offers free and paid plans. Each plan has defined limits for submissions, domains, features, and usage. We reserve the right to enforce limits and may suspend access if limits are exceeded. Current plan details are available on our pricing page.

  • Free tier: Subject to rate limits. Quizimoto branding is required on embeds.
  • Paid plans: Higher limits, optional branding removal, and additional features as described.

5. Your Content and Data

Ownership: You retain all rights to the quizzes, questions, and content you create. You also retain ownership of submission data collected through your quizzes.

License to us: You grant us a limited license to host, process, and display your content solely for the purpose of providing the Service.

Responsibility: You are solely responsible for the content of your quizzes, including compliance with applicable laws (data protection, advertising, accessibility).

6. BYOK AI Feature

The Bring Your Own Key (BYOK) AI feature allows you to connect your own AI provider API keys to generate quiz content. By using this feature:

  • You are responsible for your relationship with the AI provider and any costs incurred.
  • Your API keys are encrypted at rest but transmitted to the AI provider on your behalf.
  • We do not monitor, store, or log AI-generated content.
  • You are responsible for reviewing AI-generated questions before publishing.

7. Prohibited Uses

See our Acceptable Use Policy for detailed restrictions. In summary, you may not use the Service for illegal purposes, to collect data from minors without compliance, to distribute malware, or to abuse our infrastructure.

8. Webhooks and Integrations

The Service delivers webhook payloads to endpoints you configure. We sign payloads with HMAC-SHA256 for verification. You are responsible for securing your webhook endpoints and handling delivery appropriately. We are not liable for data exposure caused by misconfigured webhook endpoints.

9. Availability and SLA

We strive for high availability but do not guarantee uninterrupted service. The Service runs on Cloudflare infrastructure and is subject to Cloudflare's operational status. We will provide reasonable notice of planned maintenance when possible.

10. Intellectual Property

The Service, including its design, code, and documentation, is owned by Quizimoto. The embed runtime, dashboard, and API are proprietary. Open-source components are attributed on our Attributions page.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUIZIMOTO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Termination

  • You may delete your account at any time from account settings. Deletion is processed within 30 days.
  • We may suspend or terminate accounts that violate these Terms or the Acceptable Use Policy.
  • Upon termination, we will retain your data per our Privacy Policy retention schedule, unless you request earlier deletion.

13. Changes to Terms

We may update these Terms. Material changes will be communicated via email at least 30 days before taking effect. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions.
